Article 6a

Use of Intellectual Property

(1) Institutional Title Custodianship:

• To preserve the integrity, neutral stewardship, and legal enforceability of standardisation deliverables, all copyrights, collective trademarks, and repository titles developed under the OPENBHARAT schema and associated working bodies vest in ISAIL.

• ISAIL holds all such intellectual assets in trust for the benefit of the sovereign technology ecosystem, guaranteeing that specifications and benchmark artifacts remain unencumbered by unilateral private proprietary capture.

(2) Permissible Licensing Regimes: Every OWG must adopt an approved open-licensing route at track inception, categorized under one of the following paths:

• Permissive Track: Apache License 2.0 or MIT License for developer tooling, core reference codebases, SDKs, and synthetic dataset generation harnesses.

• Standard & Document Track: Creative Commons Attribution 4.0 International (CC BY 4.0) or Open Web Foundation agreements for normative specifications, architectural guidance, and policy instruments.

• Copyleft Track: GNU General Public License v3 (GPLv3) or GNU Lesser General Public License (LGPLv3) where preventing closed proprietary forks is deemed technically necessary by the OWG Convenors and the OBGC.

• Behavioral / Open-Weight Track: Responsible AI licenses (OpenRAIL variants) for high-risk weights, sovereign foundation model parameters, or specialized fine-tuning checkpoints requiring explicit behavioral guardrails against unlawful deployment.

(3) Contributor License Agreements (CLAs): All individuals, developer collectives, and institutional representatives contributing to OpenBharat.net repositories must execute either an Individual Contributor License Agreement (ICLA) or Corporate Contributor License Agreement (CCLA) administered by the Secretariat before contributions can be merged into official releases.

(4) Devolution and Institutional Succession:

• In the event of an institutional restructuring, operational spinoff, or creation of a dedicated sovereign standards foundation succeeding OpenBharat.net, ISAIL may formally transfer, assign, or sub-license the institutional titles, OPENBHARAT trademarks, and repository rights to such designated successor entity.

• Any successor entity must be formally bound by the constitutional principles of open standardisation, non-assertion patent pledges, and open-source accessibility established under this Charter and the Bharat Pacific Principles of AI Standardisation.
