Article 34 | Disclaimer of Warranties and Representations
(1) General Disclaimer of Deliverables: OpenBharat.net, the OpenBharat.net Governing Council (OBGC), the Indian Society of Artificial Intelligence and Law (ISAIL), the Secretariat, and its convenors and members make no warranties or representations, express or implied, regarding the technical accuracy, completeness, operational reliability, performance, or suitability of any AI standards, guidelines, architectural reference designs, algorithmic frameworks, benchmark harnesses, or software artifacts developed under OpenBharat.net. All utilization, implementation, or reliance upon such materials proceeds at the user's sole risk and discretion.
(2) Security, Vulnerabilities, and Intellectual Property:
No warranty or representation is made that OpenBharat.net outputs, open-source repositories, or model weights are free from defects, bugs, runtime vulnerabilities, security backdoors, adversarial weaknesses, or patent/copyright infringements.
Implementers and deploying entities bear sole responsibility for conducting independent algorithmic audits, adversarial evaluations, code assessments, and due diligence prior to deploying any outputs in production, commercial, or safety-critical settings.
(3) Regulatory and Statutory Non-Endorsement: OpenBharat.net outputs do not constitute formal statutory certifications or legal compliance guarantees. Deploying entities remain solely responsible for ensuring that their downstream implementations satisfy applicable data protection laws, consumer safety regulations, intellectual property requirements, and sector-specific statutory mandates.
(4) Commercialization and Merchantability: All deliverables are provided strictly on an as-is basis. OpenBharat.net, the OBGC, and ISAIL disclaim all implied warranties of merchantability, title, quiet enjoyment, fitness for a particular computational purpose, or commercial feasibility.
(5) Severability: The disclaimers established under this Article shall apply to the maximum extent permitted under applicable law. If any clause or portion thereof is deemed invalid or unenforceable, it shall be severed without invalidating or impairing the enforceability of the remainder of this Article.
(6) Independent Member Representations: Any technical warranties, safety benchmarks, operational representations, or commercial warranties made independently by an Alliance Member concerning its own proprietary systems, products, or service wrappers remain the sole responsibility of that member entity and shall not be imputed or attributed to OpenBharat.net, the OBGC, or the ISAIL Secretariat.
