Article 21 | Rights of Alliance Members

 

(1)   All Alliance members shall have the right to participate in the activities of the Alliance, including meetings, workshops, conferences, and other events organized by the Alliance, subject to the rules and procedures established by the Governing Body.

 

(2)   Alliance members shall have the right to access the resources, materials, and publications developed by the Alliance, including standards, guidelines, best practices, and research reports, subject to any applicable confidentiality or intellectual property provisions.

(3)   Alliance members shall have the right to vote on matters related to the governance and operation of the Alliance, as determined by the Governing Body. The voting rights of members may be differentiated based on their membership category and level of contribution to the Alliance.

 

(4)   Alliance members shall have the right to participate in the Technical Committees and Working Groups established by the ISAIL.IN Secretariat, subject to the eligibility criteria and requirements specified in paragraph (3) of Article 20 and any additional rules set forth by the Governing Body.

 

(5)   Alliance members shall have the right to be represented in the Governing Body of the Alliance, through the election or appointment of representatives from different membership categories, as determined by the Governing Body and in accordance with the provisions of this Charter.

 

(6)   Alliance members shall have the right to access capacity building and training programmes organized by the Alliance, aimed at enhancing their knowledge, skills, and capabilities in the development and implementation of AI standards.

 

(7)   Alliance members shall have the right to engage in collaboration and networking opportunities facilitated by the Alliance, including partnerships, joint projects, and knowledge-sharing initiatives with other members and external stakeholders.

 

(8)   Alliance members shall have the right to access the dispute resolution mechanisms established by the Alliance, in accordance with the provisions of this Charter and any additional rules set forth by the Governing Body, to resolve conflicts or disagreements arising from their participation in the Alliance.

 

(9)   Alliance members shall have the right to protect their intellectual property rights in accordance with the provisions of this Charter and any additional policies or agreements established by the Alliance, subject to the principles of fairness, transparency, and balance between individual and collective interests.

 

(10)                  Alliance members shall have the right to withdraw from the Alliance at any time, by providing written notice to the Governing Body, subject to the fulfilment of any outstanding obligations and the provisions of this Charter regarding the consequences of withdrawal, as stipulated below:


(a) The Member may request termination of their Alliance membership by submitting a written request to ISAIL.IN, as per Article 21(10) of the AiStandard.io Alliance Charter, subject to the fulfilment of any outstanding obligations under this Charter. The request must be sent via official communication channels (including electronic means) designated by ISAIL.IN.


(b) Upon receipt of a termination request, ISAIL.IN shall acknowledge the request within twelve (12) business days. The acknowledgment shall:​


(i) Confirm receipt of the termination request within twelve (12) business days of receipt;

(ii) Initiate a review to identify any outstanding obligations owed by the requesting member, in accordance with Article 21(10) of the Alliance Charter, which provides that withdrawal is “subject to the fulfilment of any outstanding obligations”; and​

(iii) Provide the Member with a statement of outstanding obligations (if any), including but not limited to:


(1) Outstanding membership fees or financial contributions​

(2) Pending deliverables for collaborative projects or working group commitments​

(3) Incomplete reporting requirements​

(4) Any other contractual or Charter-based obligations


(iv) If ISAIL.IN fails to acknowledge the termination request within twelve (12) business days of receipt, and provided that the Member has no outstanding obligations at the time of the request or has fulfilled all outstanding obligations prior to the thirteenth (13th) business day, the membership shall be automatically terminated effective on the thirteenth (13th) business day following submission of the request, and all membership rights and obligations ceasing on that date.


(v) Notwithstanding the immediate automatic termination available under subparagraph (b)(iv) above, the Member may elect to postpone the default termination by providing written notice of such election to the Secretariat. Upon such election, the membership shall be automatically terminated upon expiration of the remainder of the current membership term, counting from the date of the original termination request submission.


(vi) Notwithstanding the terms of this section and of the AiStandard.io Alliance Charter, no termination request shall be accepted or processed automatically or by ISAIL.IN if the term of the Member's Alliance membership is scheduled to expire due to non-renewal of membership within ten (10) business days from the date of submission of the termination request. In such circumstances, the natural expiration of the membership term shall apply, and the termination request shall be deemed null and void.
